According to lawyers, the pre-trial investigation against DTEK employees has been suspended. DTEK believes that this is another demonstration of the groundlessness of previously raised suspicions. The legality of the adoption by the National Commission for State Regulation in the Spheres of Energy and Utilities (NEURCU) of the Resolution "On Approval of the Procedure for Forming the Forecast Wholesale Market Price for Electricity" is confirmed by a number of the courts’ decisions of Ukraine and international studies.

DTEK insists that the procedure for the formation of the forecast price, to which claims have been made by NABU and SAP, has determined transparent rules for working on the Wholesale Electricity Market, which were absent up to that moment.

The expediency of using the principle of import parity and the compliance of the pricing method for thermal coal in Ukraine with the practices of European countries have been confirmed by international research, the results of which the company passed on to the investigation to establish the truth in the case. Throughout the entire investigation period, the company provided NABU and SAP with documents and responded to dozens of requests to ensure that the investigation was comprehensive and exhaustive.

DTEK expects that the completion of the investigation will put an end to groundless political manipulation and suspicions that damage the reputation of the company and its employees.
