DTEK considers NABU's statement a politically motivated provocation

The information disseminated by NABU about the rumoured recording of a conversation of one of DTEK’s top managers is a politically motivated allegation that has nothing to do with the Rotterdam + case.

Firstly, DTEK’s top management and employees have never participated in negotiations or the decision-making process on appointments to governmental positions. All interactions with industry leaders and government agencies have always been conducted exclusively within the framework of the law and in accordance with the highest standards of compliance within the company.

Secondly, DTEK will always maintain constructive engagement with professional governmental leaders who work exclusively on behalf of the interests of the industry and the state. For almost a year, the ministry of energy has not had a fixed minister to lead it. There are endless discussions concerning the appointments of a minister and his/her deputies, while the industry is becoming virtually unmanageable. Accordingly, amid deepest energy crisis, we view the accusations directed at DTEK as an irresponsible provocation in order to hide the lack of professionalism shown by government actors. The detectives chose to sensationalise numerous talks held between DTEK's top managers and representatives of Ukraine's partner countries, international organisations, and investment funds regarding the situation in the energy sector and possible ways out of the crisis. DTEK held more than ten different briefings, where the issue of both anti-crisis and professional management of the industry was always at the top of the agenda.

Unfortunately, detectives continue to make baseless accusations and attract public pressure onto the company by distorting possible value judgments and comments.

In the Rotterdam + case, DTEK had to defend the reputation and freedom of its employees, who were publicly accused of illegal actions, for over a year. Moreover, their freedom was unjustifiably curtailed, and their reputation suffered unmerited damage.

In August, the SAP prosecutor closed the Rotterdam + case. In September, the legality of this decision was confirmed by the decision of the High Anti-Corruption Court, which entered into force. The High Anti-Corruption Court also rejected NABU's demands to replace the prosecutor. Comprehensive examinations and dozens of studies by Ukrainian and international institutions and auditors have recognised the legality of the Rotterdam + formula.

After the complete failure of the investigation at NABU, the company's opponents turned to provocations and media attacks through dubious experts, motivated politicians, and media with low standards of information verification. The statement by NABU detectives is an example of unprofessional, unethical behavior in the absence of legal arguments. Despite political and public pressure, DTEK will continue to actively defend the honor and dignity of the company and its employees by all legal means within the framework of Ukrainian and international law.
